ThinkE Terms of Use

These Terms are an agreement between you and us about the ThinkE app for macOS and Windows, its trial, its licences, its updates and the website thinke.ai. You accept them when you press Start my 7 days on the first screen of the app, or when you buy a licence. If you do not accept them, do not use ThinkE.

1. Your account
You need a Google account to buy a licence. Your licence belongs to that account and to you as a person. Keep your Google account secure: whoever signs in with it can use your licence. One person, one account; an account must not be shared between people.
2. The trial
- The trial starts when you press Start my 7 days and lasts 7 days. It needs no account and no card.
- Each computer gets one trial. To enforce this, the app sends our server a one-way code derived from your computer's hardware identifier, as the Privacy Policy describes. Reinstalling the app, creating another user account on the same computer or changing the clock does not start a new trial.
- If the first start happens offline, a provisional trial starts on the computer and is confirmed with our server when the computer next goes online. If that computer has already used a trial, the provisional trial ends.
- When the trial ends without a purchase, ThinkE opens read-only. Your files are never locked: they are plain files in a folder you chose, and other apps can open them.
3. The licence
- What you get. A licence lets you use, for good, every version of ThinkE released before your updates end ("covered versions"). It is personal, non-exclusive and non-transferable.
- Year of updates. Your updates end one year after your purchase. Every version released until that date is a covered version.
- Renewal. A renewal adds one year to the later of the renewal date and the date your updates end. A late renewal therefore also covers the versions released while your updates were ended.
- Versions released after your updates end. Such a version opens read-only. We keep the covered versions available for you to download and reinstall.
- Computers. You may use ThinkE on up to 3 computers at a time. Signing in on a fourth computer asks you to free one of the others, which you can do in Settings at any time.
- Licence check. The app confirms your licence with our server whenever it is online, and needs to do so at least once every 90 days. After 60 days without a confirmation the app shows a notice; after 90 days it opens read-only until it connects once.
- Use. You may use ThinkE for personal and professional work, including commercial work.
- You may not share, sell, rent or sublicense your licence; circumvent the trial, the licence check or any technical protection; or decompile or modify the app, except to the extent the law of your country allows it regardless of these Terms.
4. Buying
- Outside Brazil. Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all those orders. Paddle provides customer service for the payment and handles returns, and its own terms apply to the purchase.
- In Brazil. Purchases in reais are processed by Eduzz on our behalf, by Pix or by card in up to 12 instalments. Instalment interest, when there is any, is charged by Eduzz to the buyer. We issue the invoice (nota fiscal).
- Taxes. Prices in EUR include VAT. Prices in USD exclude any sales tax, which is added at checkout where it applies.
- Prices may change for future purchases and renewals; a change never affects a licence already paid.
- News and offers. When you buy, you can choose to receive ThinkE news and offers by email. You can stop them at any time from the link in every email or in Settings.
5. Refunds
- You may ask for a full refund within 30 days of a purchase or renewal, from Settings → Licence →
Request a refund, or by writing to support@thinke.ai. No reason is needed.
- Purchases through Paddle are refunded automatically.
- Purchases through Eduzz are refunded through Eduzz's own refund request, which the app opens for you.
- A refund ends the licence or the renewal it paid for. Your files are not affected.
- After 30 days there is no refund.
- This guarantee is in addition to your statutory rights. It is longer than the 14-day right of withdrawal of the European Union and the 7-day right of withdrawal of the Brazilian Consumer Code.
6. When we may cancel a licence
We may cancel a licence if its payment is reversed or disputed (chargeback), if it was obtained by fraud, or if these Terms are breached. We tell you why by email, and you can answer us. A cancelled licence can be reactivated when the reason no longer applies.
7. Your files and your work
Your notes, documents, drawings, summaries and chats stay in a folder on your computer. We do not receive them, we cannot read them, and we claim no rights over them. You are responsible for keeping your own backups.
8. The AI in ThinkE
- ThinkE's AI runs on your computer. Its answers, summaries, drawings and suggestions can be incomplete or wrong. Check them before you rely on them, especially for legal, medical, financial or other important decisions. You are responsible for how you use them.
- Some of the models ThinkE uses are provided under and subject to the Gemma Terms of Use (ai.google.dev/gemma/terms). You agree not to use them for any purpose that the Gemma Prohibited Use Policy (ai.google.dev/gemma/prohibited_use_policy) forbids. This restriction is an enforceable part of these Terms.
9. Updates and changes to the app
ThinkE checks for updates and installs covered versions automatically; you can turn this off in Settings. A new version may add, change or remove features.
10. Third-party software
ThinkE includes open-source software under its own licences, listed in Settings → About → Licences and in the app's licence files. Those licences govern those components.
11. Warranty
ThinkE is provided "as is". To the extent the law allows, we give no warranty that it will be uninterrupted, error-free or fit for a particular purpose. Nothing in these Terms limits warranties or rights that the consumer law of your country gives you and that cannot be waived.
12. Liability
To the extent the law allows, we are not liable for indirect or consequential loss, or for loss of data you did not back up, and our total liability is limited to the amount you paid us in the 12 months before the claim. These limits do not apply to liability that cannot be limited by law, such as for fraud or for death or personal injury caused by negligence.
13. Changes to these Terms
We may change these Terms. We tell you in the app or by email at least 30 days before a change that affects you takes effect. A change never takes away what a licence you already paid for gives you.
14. Law and courts
These Terms are governed by the laws of Brazil. If you are a consumer, you keep the protection of the mandatory consumer law of the country where you live, and you may bring a claim in the courts there.
